1. Service Agreement & Scope

These Terms of Service ("Terms") govern all services provided by Koala Locksmith, an independent mobile locksmith service operating under that trade name in Jacksonville, Florida and surrounding areas. By requesting, scheduling, or accepting our services, or by using this website, you agree to these Terms.

Our services are performed on-site at your location within our service area. Scheduling is subject to technician availability. Any arrival time we give you is an estimate only, not a guarantee — traffic, weather, prior jobs, and other factors outside our control can cause delays, and we are not liable for costs or losses caused by a delayed or rescheduled arrival.

2. Pricing & Estimates

All prices quoted by phone, on this website, in advertisements, or in messages are estimates, not binding offers. The final price depends on factors that often cannot be confirmed until a technician inspects the job in person, including:

• The condition of the vehicle, lock, or ignition
• The type of key or transponder required and its programming complexity
• The actual work required once the job is assessed on-site

Your technician will confirm the price before starting work. You are free to decline service at that point, subject to any applicable service-call fee described in Section 9.

3. Proof of Ownership & Right to Refuse Service

Before unlocking a vehicle or property, making keys, or performing similar services, we require a valid government-issued photo ID and proof of ownership or authorization — for example, a vehicle registration or title matching your ID, or documented permission from the owner.

We reserve the unconditional right to refuse or discontinue service if ownership or authorization cannot be verified, if we suspect fraud or illegal intent, or if we have any safety concern. A service-call fee may still apply if a technician was dispatched (see Section 9).

4. Assumption of Risk & Property Damage

Locksmith work — including lockout entry, key extraction, ignition work, and lock manipulation — carries an inherent risk of cosmetic or mechanical damage even when performed correctly with professional tools. This risk is significantly higher on locks and ignitions that are worn, damaged, corroded, aftermarket, or have been previously repaired or tampered with.

By requesting service, you acknowledge and accept this inherent risk. You acknowledge that pre-existing wear or damage may make some incidental damage unavoidable. We are not responsible for pre-existing damage or defects, for damage that results from the pre-existing condition of your lock, ignition, or vehicle, or for consequential issues arising from your vehicle's electronics, battery, or immobilizer system that are beyond our control.

5. Limited Service Warranty

We warrant our workmanship for 30 days from the date of service. If the same issue we worked on recurs within that period due to our workmanship, we will re-service it at no additional charge. This is a limited warranty:

• It covers re-service of the same issue only
• It does not cover damage from misuse, accident, subsequent tampering or third-party work, water or environmental damage, or vehicle electrical problems
• Repair or re-service is your sole and exclusive remedy under this warranty; it does not entitle you to refunds of unrelated costs

Parts (keys, remotes, locks, hardware) may carry their own manufacturer terms, which your technician can explain at the time of service.

6. Disclaimer of Warranties

EXCEPT FOR THE LIMITED WARRANTY IN SECTION 5, ALL SERVICES AND ALL WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOALA LOCKSMITH DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, AND WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

Excluded damages include, for example, towing charges, rental car costs, alternate transportation, lost time or wages, missed appointments, and loss of use — whether or not we were advised such losses were possible. Some jurisdictions do not allow certain limitations, in which case these limits apply to the fullest extent the law permits.

8. Indemnification

You agree to indemnify and hold Koala Locksmith and its technicians harmless from any claims, damages, losses, and reasonable costs (including attorney fees) arising from false or incorrect ownership or authorization information you provide, or from a service request you were not authorized to make.

9. Payment

• Payment is due in full upon completion of service
• We accept cash, major credit and debit cards, and common digital payment methods
• A service-call (trip) fee may apply if you cancel after a technician has been dispatched, or if the technician arrives and you cannot be reached at the service location

10. Third-Party Trademarks

All automobile manufacturer names, logos, and trademarks referenced on this website are the property of their respective owners and are used for identification purposes only. Koala Locksmith is an independent locksmith service and is not affiliated with, endorsed by, or sponsored by any automobile manufacturer or dealership.

11. Intellectual Property

All content on this website — including text, images, pricing guides, and graphics — belongs to Koala Locksmith or its licensors. You may not reproduce, copy, or redistribute it without our prior written permission.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Except as provided in Section 13, the exclusive venue for any dispute is the state courts located in Duval County, Florida.

13. Dispute Resolution

If you have a dispute with us, contact us first — most issues can be resolved quickly and in good faith. If we cannot resolve a dispute informally within 30 days, it shall be resolved either by binding arbitration on an individual basis, or in small-claims court in Duval County, Florida if the claim qualifies.

YOU AND KOALA LOCKSMITH EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION; ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY.

This Section is severable: if the class action waiver or any other part of it is held unenforceable, the remainder of this Section and these Terms remains in effect.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Any unenforceable provision will be reformed only to the minimum extent necessary to make it enforceable while preserving its intent.

15. Changes to These Terms; Entire Agreement

We may update these Terms from time to time. The current version will always be posted on this page with its "Last updated" date. Continued use of our services or website after changes are posted constitutes acceptance of the updated Terms. These Terms constitute the entire agreement between you and Koala Locksmith regarding our services and this website, and supersede any prior understandings on the same subject.
